      "In the name of God Amen"
      I, Elias D. Kitchen, Sr. of the county of Pulaski in the State of Missouri and considering the certainty of death and the uncertainty of the time thereof and to the end that I may be better prepared to leave this world when it shall please God to call me hence do make and publish the following as my last will and testament.
      Item 1st I give and bequeath unto my sister Margaret Kitchen all my Real and personal estate to have and to hold during her natural life and at her death to do with as she may think best paying out of the same, all my just debts and funeral expenses.
      2nd Lastly I hereby nominate constitute and appoint my friend Lewis F. Wright (in whose confidence I very much rely) my sole executor hereby giving to him full power and authority to come into effect my wishes as above expressed.
      In testimony whereof I have hereunto set my hand and seal this 8th day of October in the year of our Lord 1853.

      Be it remembered that on this 5th day of Sept. 1865 personally appeared before the undersigned Horace Wilcox, clerk of the county court in and for said county state aforesaid William Arthur of law ful age says that he was acquainted with Elias D. Kitchen the testator in the annexed will in his life time and I was also acquainted with James Brown one of the subscribing witnesses thereto and with his hand writing having frequently seen him write his name and that to the best of his knowledge and belief the signature of Elias D. Kitchen to the said instrument of writing is in the proper hand writing of the said Elias D. Kitchen and that the signature of the said James Brown as a subscribing witness there to is the proper hand writing of the said James Brown and the said William Arthur further deposes and says that the said Elias D. Kitchen and James Brown were neighbors and friends and that he has heard the said Elias D. Kitchen say that he had made a will.

Lenox of lawful age and being first duly sworn deposes and says that she was well acquainted with Elias C. Kitchen the testator in the annexed will in his life time but was not acquainted with his hand writing she was also well acquainted with David Lenox on of the subscribing witnesses thereto and with his hand writing having frequently seen him write his name and that to the best of knowledge and belief the signature of said David Lenox hereto is in the proper handwriting and that the said David Lenox was his father and she has heard him speak of the annexed will in his life time that he is now dead I also know that James Brown the other subscribing witness to said is dead.

      Be it remembered that on this 5th day of september 1865 personally appeared before the undersigned Horace Wilcox clerk of the county court within and for the county of Phelps and state of Missouri, Mary Jane Brookshire of lawful age and being by me first duly sworn, deposes and says that she was well acquainted with Elias D. Kitchen the testator in the annexed will in his lifetime and with his hand writing I was also well acquainted with David Lenox and James Brown the subscribing witnesses thereto but did not know there hand writing very well, but I was well acquainted with Elias D. Kitchen's hand writing having often seen him write as I was raised by him and his sister Margaret Kitchen from a small girl, I further say that I was present when said will was wrote and signed and that I know the same was written by James Brown and was signed by the said Elias D. Kitchen as his last will in the presence of said David Lenox and James Brown and in my presence and the said David Lenox and James Brown signed the same as witnesses in the presence of the testator and each other and my presence on the day and date mentioned in said will that the said Elias D. Kitchen and the said David Lenox and James Brown were neighbors and friends and I have heard the said Elias D. Kitchen speak since of having made his will refering to the annexed will as it is now present
